State Of The Union 2007

In last night's State of the Union address, President Bush made medical malpractice a priority.

I was surprized by Bush’s priorities to be addressed. Laws preventing frivilous medical malpractice lawsuits, tax breaks for those with employer-provided insurance, and a overall decrease of oil dependence by 20% seem like good things to work towards! I must admit that i have my reservations that any of those things will be accomplished with the overall result being for the greater good.

Supreme Court Update

From a good update on recent Supreme Court rulings, this note on medical malpractice.

A couple of other cases merit mention. In Celmer v. Rodgers, the 11th District had upheld the trial court’s allowing an expert witness to testify in a medical malpractice case, despite the fact that he hadn’t practiced in seven months. The court adopted a loose interpretation of Evidence Rule 601(D)’s requirement that an expert in such a case had to “devote at least one-half of his or her professional time to the active clinical practice in his or her field of licensure,” finding that the rule was more directed toward determining the expert’s past experience rather than present activity.

Are the Vioxx lawyers killing drug discovery?

VIOXX is of course off the market, meaning that millions of arthritis sufferers are unable to take advantage of the pain relief it provided despite thousands -- thousands -- of courts deciding that VIOXX did not cause adverse side effects.

Texas Considering HPV Vaccine Requirement

The Texas HPV vaccine bill would have an impact on Vioxx settlements, too.

In the process, the health of about 162,000 sixth-grade girls living in Texas may be affected by the legislature's final decision as well as the coffers of Merck looking to a means to pay for all those lawsuits and legal fees associated with their killer drug, Vioxx.

Where Are They Now?

Bet you didn't know that personal injury lawyer Brad Cohen appeared on The Apprentice.

Brad was last reported as also into politics, running for City Commissioner in Fort Lauderdale, Florida. As well, he continues to run his own law firm, successfully taking on numerous high-profile clients at his criminal and personal injury law practice in Fort Lauderdale, Florida; sees his real estate properties renting out exponentially faster (having appeared on “The Apprentice”); and has, he tells NBC Apprentice site visitors, “developed a T-shirt line and signed an exclusive deal with Nordstrom.” Hmm. Wonder if they read, “I survived Apprentice and all I did was make these lousy tee-shirts”?
