The McClone Burger

Some questions here about the FDA, Vioxx, and clones.

Now its not that I dont trust the folks at the FDA. After all, they are the ones who gave us Vioxx, Thalidimide, and DDT. All perfectly safe. I guess I just dont see the rush. Why not serve this stuff in goverment lunch rooms for a few years, with a side order of Freedom Fries, and see what happens. Im sure our Gentleman Rancher President would be happy to dine on Fillet of Clone for the good of our nation.

Leverett Inserts Foot

Comparing Bush administration policies with medical malpractice here.

He compares the Bush administration’s unwillingness to engage in ‘talks’ with Iran as the equivalent to ‘medical malpractice’, using as evidence the 6+2 talks on Afghanistan and an Iranian “overture” to the United States in early 2003 as diplomatic success stories. Both of these claims are stupid.

Eli Lilly And Zyprexa

Is Eli Lilly to Zyprexa the same as Merck to Vioxx?

It clearly reminds me of Merck that did exactly the same regarding Vioxx and Pfizer also misled everyone with regards to Celebrex and Bextra.

What Is Personal Injury?

Some good examples of personal injury law cases here.

Other examples of personal injury cases involve product liability, slip and falls, industrial accidents, farm accidents and medical malpractice. If the injury is caused, even partially by someone else’s fault, a claim should be investigated.

Not So Obvious

A post about the Open and Obvious Doctrine and personal injury law.

The motivation for the open and obvious doctrine is easy to discern: it is ridiculous for a plaintiff to recover for an injury which he could easily see and guard against. But given the current climate of personal injury law, why shouldn’t juries be allowed to make those determinations, instead of judges? Is the judges’ “gatekeeper” function really necessary? It’s hard to imagine juries finding a plaintiff less than 50% negligent — the cutoff for any recovery — if the condition truly is open and obvious. Going back to handling this issue through a comparative negligence analysis would probably lead to the same results, would be more intellectually consistent and coherent, and would help restore courts and juries to the respective roles they were intended to perform.

Xbox 360 Class Action Suit

Is it a class action suit, or just a rebate on the XBox 360?

According to QJNet Redrum6622 claims he has filed a class action law suit against Microsoft regarding the Fall Dash Update.Shortly after Xbox owners downloaded the Fall Update, complaints started Some claimed random system freezing in the middle of games. His expierence must have been even worse for him to file this class action lawsuit, if indeed he really did.
