Sticks and Stones Break My Bones
On September 30, 2004, Merck & Co Inc (MRK) recalled Vioxx due to negative clinical trial results. Recipients of this drug seem to experience increased experience of heart attack, stroke, blood clots, or intestinal bleeding. Both the American Journal of the American Medical Association and the New England Journal of Medicine stress the dangers of this prescription drug. European and American cardiologists recognize the implicit dangers of this highly marketed arthritis prescription. This does not have to happen to you when safe natural and effective arthritis pain relief might provide relief!

EPS, SFA And Millennium Merge
What i've heard is that the new entity will take dead aim at the Mass tort market in an attempt to capture the assets and premium that will be created when, or if, asbestos, vioxx, celebrex, etc, start to be organized into settlements. It's an institutional strategy of "bigger is better" so that they can demonstrate they have the reach to handle a national mass tort, and in it's way is a continuation of the old defense model of capturing a source of premium, and then building out offices to handle the regional servicing of that account. The question will be whether or not trial lawyers are going to be as amenable to this strategy as the casualty companies were in the past.

Risk Versus Danger
The ever-increasingly empowering of patients has caused this type of question to become a regular occurance. On occasionI find myself longing for the "good old days" when patients accepted without question what the doctor recommended. Fighting with media sensationalism and internet mis-information takes a good chunk of my time. Questions were heightened with the recall of the popular drugs Vioxx and Bextra. The perception is widespread that prescription medications are dangerous while untested and unregulated "supplements" are accepted as safe.

The Foreseeability Of Life
I about fell out of my chair when I opened my fortune cookie at Lulu’s Noodle Shop in Oakland (try the pad thai) to find this treasure. My remarkable torts professor certainly would get a chuckle out of this one. In the process of studying for torts, the words “foreseeable” and “reasonable” were featured in nearly every sentence. Who among us will join the ranks of Edgar Snyder and Joel Bieber? Personal injury law seems to be the butt of nearly all jokes regarding careers and our futures. But, the only person laughing when someone’s life is destroyed by a devastating accident is the lawyer all the way to the…. Seriously, I have great respect for the field now. Although I know many of my colleagues would scoff at the idea, personal injury law seems to me to be a stimulating and highly important field.

Conrad Burns, Medical Savior
Humorously, he then wonders how we’ll control costs. This is coming from a man who has made expansion of health care technology a priority. Medical technology advancement is, of course, one of the major driving forces behind health care inflation. Of course, Burns prefers to blame medical malpractice suits, even though, in practice, their impact is overstated.

Mommy Wars or Class Wars?
Janine reminded me of a fact that she shares with me almost everytime we speak: women over 60 are the poorest segment of our population. She also pointed out how incredibly undervalued stay at home mothers are. She told me that the way to determine what the economic value is for mothers is to pay attention, believe it or not, to personal injury law where people try to put a cash value on the horrific death of a young mother. Janine explained that they rate the worth of mothers by extrapolating from blue collar jobs.

Assisted Suicide
Considering that this is America (which means “Land of the Lawyers” in Potawatomi) this is a very important question. If the assisted suicide does not work and results in additional pain and suffering of the patient and it can be proven that this was a result of improper procedure, prescribing, and/or monitoring then it should fall into the venue of medical malpractice (ironically). As with question #6 if the patient is unable to give consent for any reason then the physician cannot be held liable for not going through with the assisted suicide in accordance with the law.

MSM Leaks
"A while ago someone suggested a way for ‘We The People’ to fight back as these treasonous liberals expose us to attack. The idea was to bring a class action law suit against the media outlets who recklessly expose our defense mechanisms to our enemies.

Rogue Supreme Court
The Wisconsin Supreme Court is continuing on its quest to dismantle any sensible litigation protection left in Wisconsin. It started a while back with its lifting of medical malpractice caps and the destructive lead paint ruling. Now this:
