Laws Limit Vioxx Claims
Fox News reports on a man in Michigan who can't sue Merck in Michigan for the injuries he received from taking Vioxx. Huh?? How fair is that?
A 1996 state law prohibits lawsuits against drug makers if the drug in question is approved by the Food and Drug Administration
Here's the rational behind the law...
Chuck Hadden, a spokesman for the Michigan Manufacturers Association (search), said it makes good business sense to protect pharmaceutical companies whose products are already subjected to extensive federal testing.
But then...Fox also reports that Merck may have known of the risks much much earlier. So the allegation is that Merck may have hidden what it knew just to keep Vioxx on the market.
