HSBC Class Action Suit

This blogger is calling for a class action suit against HSBC.

We faxed the copy of the cashed money order from our bank and letter stating the facts to Malasia twice and san,diego. They claim the don’t know any thing about it. Look if anyone else is thinking Class action law suit then count us in. Between constant calls saying we did not pay and trips to kinkkos to fax letter, we have’nt had time to grieve my mothers death. Look its fraud and I’m sure of it now. How does a company do this?

Hay all, I need help with research, on class action when plantiffs are in different states. Please see what you can find so we can all move forward and I will do the same. Wondering if we need to petition the federal attorneys office or what ever it's called for that.

I want in on a lawsuit! We need this to happen now. If anyone posting on here knows any lawyers who can handle this please advise them to visit this forum and start contact all of us. I could tell my story but it is nearly identical to every other post on here. Again somebody has to know a lawyer. We can do this.

Teri. I know the feeling when we try to pay by check or through our Bank funds do not get applied the only way funds are applied is if I call and make payment arrangements through them. I am researching class action suits in multiple states and soon I will post information for people who want to jump on board.

I have Hsbc and just got done with their 6-month mod- the decrease in payments for this 6-month doesnt really help because it ended up only being 100.00 less but I took it anyways. this all ended in Oct. I made oct payment and when i went to pay nov payment the account says i owe double the amount because octobers hadnt been recieved- i knew that wasnt true so i clicked on Transaction activity and there is the Octobers payment sitting in " unapplied funds". What the hell is that. Anyways i sent them a E-mail and asked them why that it is and printed out the page where it clearly shows they have the payment. Man i hate this company.
Also when we refianced 5 yrs ago we were never told anything about a balloon payment on the 2nd mortgage till the closing day, when we questioned this and were going to cancel the whole thing the lawyer who was having us sign the papers told us " Oh dont worry about that you have 5 yrs to just refinance it before its due. The only problem with that is HSBC refuses to do that now. I also dont understand how the 2nd mortgage started out at only $23000. we have paid on it for 5 yrs to date and now it says we owe $28000. WHERE DID THE 5 YRS OF PAYMENTS GO......THEY SUCK AND THEY ARE RUDE AND THE PHONE CALLS 6-8X A DAY ARE TERRIBLE!!!!!!!! IF THEY WOULD CHECK THE ACCOUNT THEY WOULD SEE MY PAYMENTS ARE ALREADY SET UP ON THEIR WEBSITE BUT STILL THEY CALL. i HAVE TAKEN PICTURES OF THE CALLER ID CALLS THAT COME DAILY AND IT CLEARLY WOULD SHOW HARRESSMENT OR JUST TRYING TO IRRATATE ME.

I am also interested. Just got ripped off by "account secure" for an entire year. I know that I declined this service and was still charged. These people are CROOKS! I'm transferring my balances. If anybody has info on a class action suit, I would be happy to join!

If someboy is going to file a class action law suit please count me in, I was also a victim HSBC and I'm loosing my house, I have 2 beautiful children and a wife we are all hurt, please, please someone do something about it, this bank is from hogkong and is taking advantage of a lot of people in the us HSBC stands for hongkong and shanghai banking corporation, they are scumbags, and thieves.

I have also went through a horrendous experience w/ HSBC mortgage. I was put into hardship and told several different versions of what that meant via telephone several months back. Initially, I asked to be sent detailed documentation regarding the "excellent in-house mortgage hardship program." Weeks went by it was never sent. Then several months later I phone to tell them I will be sending my sept. payment in when I get paid mid Oct. in the hardship amount of 758 and some odd change. They said okay that is fine when I agreed to pay it on Monday Oct. 19th. I spoke to them on the 14th of Oct. to make this arrangement. I call to pay it via telephone on Monday the 19th and surprise the hardship has "expired" and I would now have to pay the regular amount not the 758 mentioned on the phone a few days earlier. I told them that I talked to someone and no one mentioned anything like this. The women said that she has no idea who would tell me this and sorry she can't do anything am I paying that amount. I informed her that no it would have to wait as I did not expect that amount. I asked why I didn't receive anything in the mail about this program expiring, etc. and she informed me that this was only done through the telephone with no documentaion requested or otherwise. Then I check the mail and discover a document from them dated Oct. 14 that stated I owed a past due of 758.00. Everytime I talk to these people about anything they have no record of me calling. I feel like I am being screwed and this has to be some level of band fraud. This is one of dozens of incidents with this company in a matter of 2 to 3 years. I could write a disertation on it. We do not know what to do and are at our wits end. Everywhere I look people are being screwed by this company. Is there going to be a class action? Does anybody have any legal advice? I have contacted the HOPE program, but all they say is nothing can be fed. modified etc. unless who owns my loan agrees to do so which they won't. I am so frustarated. I had exactly the same problem with a credit card. They charged me for some service club that I apparently joined. I called to cancel and fought for three months to get it removed.

I am eager to teach them a lesson and join a lawsuit against HSBC.

Count me in! They have jacked me around so bad. They repoed my ATV by saying it was due to late fees. I finally received all my cashed checks and itemized statement for HSBC Kawasaki and they cashed the checks and then posted them to my account late to then charge me late fees. I didn't even know about my late fees until a bill came AFTER they repoed it! HSBC sold it, and I have fought off 3 different lawyers. I am sick of dealing with it and want my ATV back that I paid $5000.00 down on. I only owed them $1600.00 left on the ATV and now they are saying that I owe them $5500.00!!!!!!!!!!! I had it for three years at 4.9% finance.
Count me in on the suit!!

HFC Beneficial is a rogue company and my wife and I feel everyone's pain. Beneficial filed a motion in court against us stated we were two months behind in our mortgage - completely untrue and we have proven it. To make a long story short, we have surrendered our house through chap 13 to prevent further harassment. Borrowed 286K in 2006, owed 298K four years later with all payments made and accounted for - we still lost in the end. I've forwarded the audit trail gathered to my congressman, and requested he collect a full accounting of all financial transactions against my deed since inception. If he is successful, perhaps I'll have something to go to court with. I know we will be better off without Beneficial, but the 150K we have invested and lost does bite. Count me in on a class action suit if ever one comes around. Y'all don't give up - we may pay these people back yet.

My credit card bill was $61.91. I disputed a $33.00 charge (written in letter-form and mailed to HSBC). I paid $28.91 ($61.91-$33.00) before the due date. The $33.00 was credited to my account due to a mistake. The next monthly statement there is a finance charge of $2.74. Called customer service. I was told it was because I only sent in partial payment. Explained why I did so and reminded the service rep that I was not obligated to pay parts of my bill that were in question (as taken from their own words located on the back of the credit card statement). No explanation sufficed. I still owe the finance charge. Imagine how much money they make by swindling a few dollars from thousands of people per year. Are there any honest people left?

I too have fell prey to HFC/HSBC. I feel so stupid for having used them. They are real crooks and I felt so slimey when I was closing the deal with them on a second mortgage for 10,000. Have never been late and made all payments but the balance never goes down. Sign me up for a class action suit anytime. As a previous writer said, they (HSBC/HFC) are what is wrong with America.

I just received a call from HSBC credit card division. I have not used the card since 2007 and got a letter about a year ago in the mail stating the account was closed due to inactivity.

Today they are telling me I have a balance of more than $100 in annual fees! Is this even legal?

I haven't received a statement online or by mail. Definitely interested in the class action thing.

Any advice? I'm filling a report on Ripoffreport.com.

I wish we could do something about HSBC. I have the same problem. I got a streetbike in 2004 and have made payments every month on time. I was late due to loss of job but was still willing to arrange something but they wouldnt. I then went to collections and arranged to pay 300 monthly with a one time payment of 2500. I made payments for a year then the collection agency stopped taking my payments and calls. I wrote letters to the collection agency and HSBC with no response.I also made calls i would get hung up on or they said i had to call another number. I was also getting billed from both parties with different amounts. The collection agency said i owed like 3500 and HSBC said i owed like 6k. This company is a scam and are crooks. Count me in on the class action lawsuit they need to be taught a lesson and how to conduct business

I too have had problems with HFC/HSBC. In Feb 2007, I met with a loan specialist in their Manchester CT store. He led me to believe I was taking a $10,000 personal loan. I ended up with a $10,000 line of credit that I have made 29 monthly payments of $207 on time, every month totaling over $6,000. Yet, I still owe over $9,700 on the principal of this line of credit. I too have had problems with the riducilous life insurance and disability insurance charges that they've been charging me and I've requested numerous times that they cancel this. Yet somehow, they have no record of any of the cancellation numbers they would give me when I'd call to have these insurances removed. I've also asked several times for an accounting, explanation, anything that would explain to me why out of the $6,000 I've paid them, not even $300 has been applied to principal. I've been told by their customer service reps that this is a line of credit. They can not even tell me how long I would need to make these payments until it's paid off. They just keep telling me "You signed the contract, you should've read it." These people have me so infuriated, I can only imagine how high my blood pressure is right now.

I am 110% behind a class action lawsuit against Househould Finance Corp & HSBC & any of their affiliate companies. I understand they are now operating out of India. There has got to be some lawyer out there who can bring a class action suit against these theives. I've seen so many complaints against this company on various websites that it makes me sick that they've gotten away with these acts for so many years.

I too would like be part of this class action suit against HFC Beneficial/HSBC. This company is doing nothing to help those who want to keep their homes, and not face foreclosure. They false advertise, stating on their website that they have a loan modification program, and the only program this company is offering homeowners in despair is a 6 month "Hardship" program that lowers your monthly mortgage payments, while all of the interst you accrue in those 6 months will be tacked on to your total loan. This is what this company calls a loan modification!!!! Please let me participate in this lawsuit that you are filing against this BAND OF CROOKS!!!!!!!!!!!!!!!!

I too would like to also join a class action lawsuit. I borrowed $10,000 from this company and have been paying on it for four years. I always send extra over and above the interest and payment due but they have never credited this off the principle. Though I have paid them back $12,500 already, they say that I still owe them $9500. When I asked why my extra payments weren't coming off the balance, they gave me a lame excuse that the fine print stated that it had to be applied to "future interest".

I have stopped sending them any money and want to go to court. Now that they have moved all operations to Asia I will send them NO MORE MONEY.

As I lost my job in December, I jumped on the opportunity to re-finance my HSBC auto loan in March. The correspondence that was sent to me had two criteria; mail a payment of X number of dollars and sign/fax the documentation back to HSBC. HSBC conviently has no record of my payment or my faxed agreement. I not only have the bank statement of the transfer from my bank account within the acceptable timeframe, I have the fax transmission report and the phone bill with the fax call that was made to them. CAN I PLEASE GET A LAWYER TO GIVE ME A CALL!!! I also have antoher issue with my Best Buy card which is held by HSBC. Seems that my electronic payment thank takes two days from Chase, sat in limbo for a week and a half before HSBC claimed it. The issue? My payment was then considered late and HSBC could now charge me their higher rate. WTF?????? I have all corresponding documentation, ARE THERE ANY LAWYERS OUT THERE THAT WANT TO TANGLE WITH HSBC?????? GIVE ME A CALL

I too am having issues with Beneficial/HSBC. I refinanced with a local Beneficial branch 8/08 from a adjustable APR to a fixed. I thought that was great at the time. Since the decline of the economy the amount of money being brought home after taxes for my husband has declined. He is in the auto industry as a auto technician. I have tried twice this year the get a hardship approved through Beneficial and both times told we do not meet the guidelines. When I ask what exactly the guidelines are and if I can speak to the person who's name is at the bottom of all correspondence I am told that that person does not have a direct extension and that the informaiton is internal. Well if it pertains to me and my financial information it most certainly is my right to speak to the person in their "internal" department. That is the most stupiest answer I have gotten yet. I called today to notify of when I would be making payments and instead of taking the information the representative stated "instead of making millions of payments you need to make a full payment" I told her if I could I would and would not have being trying in the first place to get a hardship approval. I then ask about a loan restructure and was told a request had resently been denied a few days ago. Neither my husband or I have requested this and she said that before I could ask for another restructure I would need to have two months payments made. She included the April payment and said that once the rest of the May payment is received by 7/15 then I can call back and request. They are not being very helpful. I have send information showing the decline in pay for my husband in the last six months and explained that I am doing everything I can to make payments. She said if I had at least one child then the hardship would go through. It is not my fault there are no children involved and besides what does that have to do with anything I know they have been foreclosing on families with children who have ask for help. The practices of this company need to be addressed. I even ask if our loan could be extended for an additional 4 years as we have 26 year and was told they are not refinancing and lending more money. I am not asking for more money just to have the amount owed the be refinanced for a longer term. I am going to right to President Obama and the others with the information that was provided by another post on her. This is getting out of hand. This company is not wanting to work with anyone it seems and they have a lot of legal trouble in the past and it looks like they are about to have more.

I to would like to join a class action suit against HSBC for actually changing my monthly billing statements after I disputed charges that should not have been on my statements.

Someone actually and physically changed the statements after I had printed out the originals. Now I have originals and copies of changed statements. That's like padding your books. You can't change your books. This is after I disputed charges and got NO WHERE! Some kind of insurance they charged me for, on a "same as cash plan". I paid off the balance before the promotion date.

So I filed a complaint with the BBB you know there BBB accredited, asking how they could charge me on a balance of zero. 900% interest would still be zero. My statements are still changed but as of today it looks like they credited everything back to the account and nothing is due. I also sent a dispute letter to HSBC in order to preserve my rights with USPS reciept confirmation last week. They recieved that letter June 11th and June 12th they credited my account. I have access to my phone logs and HSBC called my house 146 times in the month of April sounds like harassment to me. Even though they have credited my account I am not happy with the fact that they changed my statements in a fraudulent manner so they could charge me money I do not owe. How many others have they done this to????? I want to sue them. I have the proof now I need a lawyer.

every one here has a problem with HSBC, I have a problem with HSBC insurance , I had the insurance on my cards and a loan, had prostrate cancer in 2005 put in my claims was told I put them in to late , was denied. in 2007 had surgery on both hands put my claims in for my Beneficial loan and wrote a note to file on my credit cards as well, waited 2 months did not hear so I call hsbs ins was told my ins was with bankers life so I filed with bankers they are paying my loan payment , called hsbc insurance to check my 2 credit cards, again they denied me saying I did not put my claim in on time , I explained that I did, and that do they think I would be that dum knowing what they did before , I advised that I filed the papers the same time for the loan , they say they are a difrent dept . How can that be , its the same address. now I will claim bankrupcy on them.

My family and I have had our share of HSBC's excuses. Last Wednesday we got a letter stating that we were $10,000 behind on our mortgage and Friday a letter stating that we needed to be in court the week of June 1st so that they may proceed to foreclose on our home. The city sold our a piece of our property and in the letter we received it stated that it would go toward our payments and that our next payment was due 15 Feb. Well HSBC applied the entire amount to our principle but did not say a word to us. So their idea of negotiation is to add (which has ended up being about $18,000 with THEIR attorney's fees) to the top of our mortgage payment for 6 months. OK...they suck us dry every month and now want to add more each month...these people are crazy and if anyone knows how to help PLEASE let me know.

HSBC is about a crooked as they come. HSBC went out and purchased large blocks of loans from varoius brookers and lenders. They loans purchased not all conformed with or followed federal and state consumer protection laws. Some of these loans were aquired from Accredited Home Lenders( now filling for bankruptcy) that violated TILa, RESPA and HOPA. When confronted with facts, such as mine that show the loan is ilegal and violates the law, they hire a big law firm to foreclose. HSBC Finance, HSBC USA and HSBC Mortgage Services Inc are so well hidden under a group of hodding companies that it is able to hide from regulators. I am in court now and won a minor victory this Monday. Try as hard as they did we managed to get the judge to accept our counter claim of TILA violations. The foreclosure has been vacated, we are now seeking damages. Anyone having problems with HSBC Mortage should contact the FBI, file complaints of mortgage fraud. I did and it is now being investigated. File complaints with FTC, OCC and Federal Reserve. Contact your states attorneys and file criminal complaints, I did. Contact and file mail fraud complaints with the postal service. If FHA is involved file with HUD. If VA backed loans are involved contact the Director of the VA in Washington and last fax the white house.

This company and its leader needs to go down. And If I have my way, soon the men in the blue jackets with the big yellow letters will be knocking on his door.

PLEASE tell me when a class action law suit is filed against HSBC. They foreclosed on my house 2 weeks BEFORE they received the transfer of my loan. (How can a bank that does NOT hold a mortgage file a foreclosure?! The judge said that fact was not admissible in court) They would NOT negotiate payments when I was only 2 months late. And now, have offered a fraudulent "cash for keys program", in which I get out in a few days, and clean and paint and they pay me $500 - and pay the realty company $3000 for "negotiating" for them...They're criminal!

I would also like to join this class action. HSBC is a big company and is taking advantage of the working and non-working American. I also am getting ripped off by this company. I had financed a vehicle from them in 2003, made my monthly payments mostly on time. If they were not on time they would always be caught up by the following month with my late fees. This April is supposed to be my last payment. However, I looked at my statements and saw that HSBC had added an additional $2,000 dollars. I called up C/S and spoke to someone who I barely understood so I asked for a supervisor or manager, they hesitated and put me on hold forever. They came back on the phone with a supervisor, the supervisor told me the reason for the amount still due was because I had asked for an extension. I had told them that I never did. They insisted that I was wrong. I asked for the date of the extension they responded with some mad up date. I reviewed my records and a payment was made that month by me as well as the months prior and after that date. They had no explanation for it. HSBC told me about my late months which I did not dispute, and they said that for every late day I was charged and additional fee of interest. I responded to them and asked them where in my contract that was stated. HSBC could not find that information on the loan contract and is telling me I need to pay the additional $2,000 to completely pay off my car. My car is paid in full and with all my late charges as well, but this is ridicules that a hidden fee was never told to me and they cannot find it in the contract. HSBC is holding the title of my car hostage until I give them extra money that they cannot account for. HSBC IS A BIG RIP-OFF AND NO ONE SHOULD GET INVOLVED WITH NO MATTER HOW DESPARATE YOU ARE.

HSBC Bank hired Portfolio Recovery Associates for collection purposes. I had informed Portfolio Recovery and its respective lawyers that I was discharged from work for employment discrimination, and had a current lawsuit pending in Federal Court in Minnesota, assigned a jury trial. I was Pro-Se, which means I represented myself. I sent the lawyers a copy of a case letter, docuementation, along with a letter requesting a negotion on the matter for a lower payment, and to stop interest and fees. This was ineffective, and now HSBC and its collection agency lawyers have moved forward with a case in Minnesota District Court, costing me hundreds of dollars more to file a response and time off work.
Additionally, collection calls from HSBC bank were excessive, exceeding 20 calls in one day from 8:00am to 9:00pm, and weekends Sat. & Sun.
I am requesting a law firm accept this matter on a
contigency basis, and I would expect any Court in the land would assign Class Action Status. I am fast becoming better at representing myself Pro-Se. However, it appears this matter is far larger than than originally entered several years ago.
Please respond if you are a lawfirm who wishes to represent the people of the United States of America and abroad.

i also have been trying to find an attorney to represent me against hsbc for fraudulent charges on a mortgage modification. They added 16k to my principal( with fraudulent documentation)i have been searching diligently for a year. also, hsbc refuses to send me itemied copies of where my money went. Its not their policy.anyway, can someone steer me in the right direction PLEASE.I was told to file a class action, ot as easy as it sounds. thank you and good luck in bringing justice to the people who have been wronged by these scumbags.

I’m sorry to admit this but I’m happy to have found this site and find so many complaints against HSBC. By comparison, mine complaint is minor but approximately one year ago; I purchased a 2008 Yamaha Motorcycle from a local dealer.

Being a fool, the “deal” sounded too good to be true and was made very easy for me.
Regardless, I was making monthly, on time payments until I had to undergo a vital and routine CT scan procedure due to a history of Esophageal Cancer when I missed a payment of only one month. Of course, my mind was preoccupied with other important matters.

However, be that as it may, my APR jumped from approximately 7% to that of over 25% so I simply stopped paying and when the calls began, hour after hour, all throughout the day and evening, and even at my place of employment, I finally spoke with a Customer Service Representative.
I informed her as to what had happened and she inquired as to what could be down to “resolve” this problem. Simply put, I begged her to waive the higher rate due to my circumstances and I was told that would never happen. Period! So much for Customer Service and empathy but by now, I expected nothing from them.

I then spoke with a Supervisor who basically told me the same exact thing. Yes, they do indeed own the motorcycle and I’m not looking to obtain any merchandize for free but the stress, lack of professionalism, disrespect, willingness to negotiate and insensitivity was extremely troublesome as well as bewildering.

It was difficult to imagine a company could be so cold and callous. I was not looking for sympathy, just decent, common, professional courtesy but instead, I was treated with such disrespect that I actually lost sleep over it.

They recently repossessed the motorcycle as I knew they would. Now, I only fear what to expect next from this harsh, cruel and insensitive company. Like many others, I too would like to partake in filing a class action lawsuit if one should or already has started.

I beg anyone to please contact me at once if they should have any information concerning a suit or any other matter. Their practices of injustice have to be stopped!

I to would like to be involved in the class action suit. I lived in my home for 20 years and lost it to foreclosure. My husband and I had a hardship with our jobs and we were ashamed by them for having that kind of jobs. I tried in vain to get a lower payment and thay said I have to be late 30 days late before they would work with me. They were rude people and did not care about our hardship. I got the attorney general involved in helping me save our home and that did not get me no were. So now I am renting after 20 years of owning a home, my family is very sad that we had to move, we loved our home.

It is sad to hear that what happened to us is happening to so may people. We were finally able to refine. but it took us a year to do so with no help from HSBC. They told us that they could not help us with a refine till we were over 3 months late on our payments. To top it off when we found a bank that would help us, HSBC did everthing to stop it. So we are in.

I got a Bowflex in 2006. I had it 2 weeks got laid off and tried to return it because they claim you have 30 days to send it back they refused it. I had made a few payment but could not afford to keep them up. I have tried to work with the collectors to set up a payment plan they refused they wanted the complete balance. Now I get home yesterday and have paper to go to court in 4 days for this no warning to get any lawyer or anything. This is after all the harassing phone calls. SO I am in if one gets put together

I would like to find out about this as well. They tried to put a lien on my parents house where I used to live & my parents checking. All because me & my Dad have the same first name. They dropped that & now have a garnishment on my wages. I am trying to make a settlement, but The settlement is not very much of one. Every time I talk to them the numbers are different. I am in distress. Please help.

I have just completed my 5th call to HSBC to correct the interest rate. They raised my interest to 29.99%!! I have never been late on ANY payments. In Nov 08 I changed my primary bank and updated the information on all of my accounts, including HSBC. Of all my on line accounts, HSBC was the ONLY business to have a problem with processing my payment. I logged on to find there was an issue with this (48 hours after the payment was to post) and found it had not! I immediately called and their tech dept assisted in reentering my account information and waited to be sure my payment posted.
I know there was not an error on my part and was shocked to speak with a supervisor who insisted 26.9% was the best she could offer!

Does anyone have any information about how to fight this?

Please take a look at www.householdwatch.com It is an entire web site on HSBC because there are thousands of these stories and many resources. HFC was sued by 27 states attorney general offices for all of these and more. They were fined and settled with the states but the individuals received nothing. To HFC it was like a parking ticket. They made trillions of dollars and the Attorney General office discovered they own their own investigation corporation that actually sends people to trespass your property, go thru your trash etc. to get you to pay or give up your assets so they may resell. They do all of this fraudulent and illegal activities as they make soooo much money - they wrote the book, so HSBC bought HFC and all their practices to reap the benefits.

HSBC was told by my "friend" that i was deceased.. i moved and my "friend" took over my old phone number for a second line into her house and she was sick of them calling... so right away they threw me in all 3 credit bureaus as deceased.... can't get a job, mortgage, insurance, or credit of any kind.....

I am so glad to find this website. I don't feel so alone now. My husband and I have been doing everything we have been told to get the mortgage we have with HSBC caught up completely. We should have been there end of December and found out the extra money we paid DID NOT go towards the balance. It went into "unapplied funds"????!!!! We never authorized that and since we have been accumulating more fees (of course). My husband has ben hung up on, and even told they were having a fire drill so the rep could hang up on him. We got a notice that a check was returned for insuffiecnt amount and after calling the bank, we found out THEY NEVER PUT IT THROUGH. They are impossible, the are dishonest and they have managed to put a hold on our lives. Our mortgage has almost doubled in 8 years. We are surviving and HSBC is thriving because of people like us. Go Get Them!! We have been misled, lied to and ignored. They are impossible.

I would like to join in a Law suit against this evil company. They are charging me for fraud charges on my credit card accounts with them, even though I reported the card lost to them and provided them all the information they requested from me. Let's sue this cold blooded criminals and put the end to their fraud. Call 1-800-232-6359 fraud department talk to Robin the supervisor say you will sue them. Look up the office of the Clerks/Records you should be able to find their address make sure you get their legal name and last name for sure otherwise you won't be able to.

They got me with a Kawasaki account. Started with 5.99% apr and within a year had it to 23.99% apr. When the state max in NC for an auto loan is 18%. I have tried calling and only get rudeness and indirect answers. They refuse to work with me in any way. Even as far as moving the due date to make it easier to pay each month. If any class action suit is under way I would like to join.

My Wife and I lost our Home thanks to the money hungry people at HSBC. Our monthly payment was 561.09 and we made the mistake of having a ARm with a 2 year fixed rate. (2005) NOW (2008) my credit is destroyed. They put a bunch of collections stuff on my credit to lower my score. then when it came time to refi, everyone said NO! Our payment went from 561 to 875.45 in one month then even higher! Within 3 months our payment was over 1600.00. We could not afford this and they killed not only mine, but my wifes credit to keep us from being able to refi. I would love to sue the shit out of these greedy assholes. I'm ready to join as well.
I purchased a TV at Tweeter's in January of this year (2008) taking advantage of a 12 month no interest no payments promotion.
Several months after the purchase I started getting phone calls from HSBC's collections department.
I've explained over & over again to these people about the promotion, faxed documents, etc., and that I had even recieved a letter back from HSBC acknowledging the promotion & stating that all has been corrected to reflect it (i.e., all interest, finance charges, etc, had been removed).
Everything was fine for a little while & then all the calls & letters started up again.
Every time it's someone who doesnt seem to know what's going on there & I have to go over it all again.
Now my credit score has been adversely affected!!!
Their latest letter / phone calls state that I now owe over $4700 (original purchase price was $4053).
HELP!

I won't go into details. HSBC - Best Buy -reported I was sent to a collection agency. I still get statements from HSBC-Best Buy every month - account current- no deliquency. Called HSBC - lady said , "opps we made a mistake." Asked for correction in writing and correction credit buresus - DEAD SILENCE> NO RESPONSE - NOW IMPOSSIBLE TO DEAL WITH.

count me in to..my husband had a life insurance policy for $250K from HSBC and it was denied today 10/6/08 and my husband died in may-they kept dragging their feet 'investigating' when they had the autopsy reports from the start and would not give me any updates when I was calling to check on the status of the claim! my husband died from natural causes. I am so upset right now I can't type. They will say it is because he did not have the insurance for 2years I bet(the supervisor today said I will be receiving a letter in the mail). Our mortgage being sold to HSBC was the worst thing that ever happened. We were gullable enough to take on an interest only loan that had a two year no refinance without a heafty penalty. The payments, the contract stated, COULD go up every six months according to changes in the prime interest rate. Prime has only gone down by my payments in 6 months went up 1200. We inquired about programs and with HSBC to aid with converting to a fixed rate but were consistently told, "We can do nothing for you until you are delinquent." Of coure our response was that we were doing everything possible to not become delinquent. In the end the home went to short-sale and we are left with owning $87K on a home we don't live in. HSBC had the opportunity to conduct sound business and act in good faith to a customer but choose a different route. I spoke with an attorney about the terms of the short-sale agreement and was advised to have it ammended. HSBC became irate and threatened to pull the agreement. I offered a class-action suit and they became even more incensed. Nothing would make me happier than to be party to a class-action suit against HSBC. Please let me know how to sign-up.

We too would like to join a lawsuit. This company needs to be stopped dead in their tracks!!! Just yesterday my son had his fourwheeler repossessed (7:30 pm) and then they came back first thing this morning and repoed his street bike. Not only do they "double dip" and get unwarranted penalties added on to your loan balance, they "double dip" by coming out twice so we have twice the amount of "fees" tacked on to everything, making it almost impossible to get the items back. My son has been charged late fees numerous times because he didn't "make his payment within the seven day window" they allow you to make them before the payment is either applied to the principle (because the payment was paid to soon after the last payment-even though it's a different month) OR because the payment was deemed late because the payment didn't make it to HSBC in time.

I know for a fact my son has tried everything to work out payment options with HSBC, but nothing was acceptable to them...after all...if suitable arrangements were made...they couldn't make all the money they make each month.

One more food for thought....the guy who came to repossess the fourwheeler last night told us he has picked up 30 "units" already this month. That is 30 units in only 9 days!!! No wonder HSBC isn't more agreeable to "workable solutions" for the customer.

I have dealt with HFC for 9 years now and they have harrassed me to no end. The most recent one was, in July I changed my due date and changed the date for my EZ pay. I had the date changed from the 5th to the 20th. They took the payment out on Aug 20th but NOW are claiming that I owe 2 payments and owe late charges. They have also started calling me numerous times a day AND emailing me too.

HFC did a 3rd mortgage for us which we could not afford. They caught us at a time when we were having financial difficulties and told us not to go through a credit counselor as that was almost as bad as a bankrupcy. They did not do an appraisal, and gave us 125% of the value of the home. This caused extreme financial problems. Does anyone know how we can file a suit against them. I don't even know where to start. Thanks

We too had a mortgage loan with Beneficial... My husband lost his job and we could not keep up with the payments we were catching up and they just kept tacking on fines and what ever they could. We went into forclosure and they took the house. They ruined us they wouldnt even let us try to get things fixed. If anyone gets in contact with a lawyer please let me know cause I think that it is time for the little people to give back to big business and they need to be shut down.

Where do I sign up? Those people are monsters!!! I lost my Mom Aug 15,2003, she had a mortgage loan with Benefical. I contacted them then they told me to send the death certificate in and everything will be taken care of. 2 months later I get a forecloser notice. They wouldnt recognize for at least 20 months that my Mom was even dead! They even send Invoices to me Addressed to DECEASED Maschack. HOW APPALLING!!! How could anyone do that? After a couple more months I was able to convince them to close the account and remove the lien. They did it really quickly for some reason. Maybe cause I had a giant lawsuit in my hand that read DECEASED? I hadnt heard anything after that for a couple of years. Suddenly I get 3 calls in 2 weeks demanding I make a payment to Benefical. This person had my Moms Name, Account number, My telephone number, the date the last payment was made and how much it was. So, I call them today to tell them about the calls and I also wanted to know a few other things. Now, I am really wondering alot more. I want to know who the person was that changed my Mom's name to DECEASED for one...!!! Also who has been calling and if its not them who is it and where did they get this information from? If I couldnt even convince them who I was and my Mom was dead because of the strict privacy they have, then how is someone else able to get this info when I couldnt? I have some real issues with Benefical. Disgracing my Mom's good name for starters. These people need to pay.

I have contact OCC, FTC, Bank of Nations, BBB HSBC resolution, I even contacted Attorney General Roy Cooper
HSBC sent only two of the letters to Bank of Nation they mailed me but not the last one showing all the fraudulent documents mailed + they didn't send over where the disability & credit life was cancelled.
My house goes up for sale tomorrow.
One reason I am highly upset & refuse to pay HSBC is due to the date I finance with them 7/2/97 is because that was the day my daughter's half of her face was bitten off by a dog & HFC knew about it & acted so concerned

My mortgage papers closed from Saxon & Meriteck thru 9/1996.
My mortgage papers showing when I finance with HFC 7/2/1997
Cancellation of credit & life insurance however it was added into my loan & deducted from a home loan
My credit report showing opening date of HFC, Saxon & Meriteck.
I am now am being forced to evacuate by 6/17/08 due to monies due me & I refused to pay HFC due to fraudulent documents sent to me
I am requesting for HFC/ HSBC to give me until the end of the month to move out if possible.

I am also interested in any class action lawsuits regarding HSBC and their HFC affliliate. I had to file a Better Business Bureau (BBB) complaint against an HSBC account they had assumed from another company. They were calling and harrasing me and my family daily and on weekends and even called my job for no valid reason. When the collectors called they could not explain to me why they were calling, as the account was up-to-date. I am now quadrupling the requested monthly amount to give them no reason for not applying funds to my account. They would add in exhorbitant fees and add in amounts to ensure the account appeared over limit. I am disgusted with both companies because of their bad business practices. I did receive a written and verbal apology after filing the complaint and the issues were partially resolved. They never did apply back exhorbitant over limit charges to my account. I was told my account for HFC would never be reduced despite the fact that I am paying the requested monthly amount, if I continued to send the minimum payment due each month. I am now sending them additional funds to apply to the balance. This has been a stressful time for me and my family. The calls have stopped and I am reconsidering re-opening up the BBB complaint against the "revolving" account to ensure my hard earned money is being applied and reflected in the monthly balance.

I too have problems with hsbc finance, they are making harassing calls, everyday they say I owe a different amount, I have proof I dont right from their web site. I recently notifed the attorney general , and I'm not going to stop until we're in court. I'm seeking counsel, I have proof of the harassment. they can't win, especially harassment on my employers phone line. all calls are traced and monitored, when I tell them they are being recorded they hang up!!

We have nothing but problems our payment have jumped up by $500 a month, plus they claim we own back payments from our excrow for taxex and insurence. They lied to us about addition money we had in our account whci was over payment they claim, we ask for it back in a check and was told it would take 7 to 10 days. Whe we called them back they told us they applied it to the principle. We are still waiting for a refund from the insurence they were takin out of the escrow. We already have insurence thur Allstate. My husband lost a great paying job @3 years ago. We had refinanced our home 1 year prior with Oak Street Mortgage(who by the way is now bankrupt and out of business). Our loan was sold to HSBC. Little did we know at the time that we had had an over inflated appraisal. We had to file bankruptcy. That did not help, then HSBC was raising our payments, tacking on fees and demanding a balloon payment. They were forcing us into foreclosure. My husband's uncle is in real estate. He tried to contact the company several times, as well as a local bank representative and a real estate attorney. All of the calls were dead ends. No one on the other line had a clue about how to work with us in our situation. By the time that we were able to contact someone who might could help, we were told that it was "too late and the home would be auctioned off." We even had an investor who was willing to pay fair market value for the home. NO DEAL we were told. They were demanding the amount of the loan plus interest which caused the loan to be upside down by @25,000. They foreclosed on our home which we owned for 18 years. No one purchased the home at the auction and HSBC retained the home. By the way, the home was recently sold by HSBC's real estate company to a friend of ours for @40,000 below market value. That is 65,000 below what they were demanding from us. And people wonder what is wrong with our economy. If these big banks would take the time to listen and help those in need. Maybe something could be done. As for the class action lawsuit. Count me in!!!!What do I have to lose. They have already taken everything I had.

My husband lost a great paying job @3 years ago. We had refinanced our home 1 year prior with Oak Street Mortgage(who by the way is now bankrupt and out of business). Our loan was sold to HSBC. Little did we know at the time that we had had an over inflated appraisal. We had to file bankruptcy. That did not help, then HSBC was raising our payments, tacking on fees and demanding a balloon payment. They were forcing us into foreclosure. My husband's uncle is in real estate. He tried to contact the company several times, as well as a local bank representative and a real estate attorney. All of the calls were dead ends. No one on the other line had a clue about how to work with us in our situation. By the time that we were able to contact someone who might could help, we were told that it was "too late and the home would be auctioned off." We even had an investor who was willing to pay fair market value for the home. NO DEAL we were told. They were demanding the amount of the loan plus interest which caused the loan to be upside down by @25,000. They foreclosed on our home which we owned for 18 years. No one purchased the home at the auction and HSBC retained the home. By the way, the home was recently sold by HSBC's real estate company to a friend of ours for @40,000 below market value. That is 65,000 below what they were demanding from us. And people wonder what is wrong with our economy. If these big banks would take the time to listen and help those in need. Maybe something could be done. As for the class action lawsuit. Count me in!!!!What do I have to lose. They have already taken everything I had.

We have had a ton of problems with HSBC as well, We are on an adjustable which clearly states it MAY increase every 12 months no more than 1% from what we where paying in the last 6 months per our RIDER. They increased my loan by 2% HSBC has no regards for our IN WRITING CONTRACT. I have called them on it and advised them that they are breaking a written contract and this is not what we signed up for. The gentleman on the phone was very rude, when I asked to speak to a supervisor I was transfered form person to person was never assisted for about 2 weeks.
I have since stopped making my mortgage payments because I could not afford such a dramatic increase in my payments and I'm now facing foreclosure.
They know they can walk all over the little people and its very sad. I need to win the lottery so I can sue the living S@#t out of them.

I have a loan for 10,000.00 with beneficial which is Hsbc we are in court. because my husband got sick would could not pay. I called them they said they would resturucture and they did. They add when all of it to the interest. So when I made payment it was all interest. They filed suit and we now no that there was ins. that they put on with out me knowning but they took off the account after all the interset pilled up.they got a judgment for 13,914.49 and i had paid 6200.00 that did not count.

Just like many of you, we have major problems with HSBC too. They have tried to put our house up for foreclosure twice. This is the third time and they succeeded. My daughter and I have to move out, and now we are currently struggling to find a place to live. They screwed up my credit so I can not refinance, I have to pay 500 dollars to get my credit straight to get another house.

It started when I got sick in Oct. and fell behind, me and HSBC agreed on a date to makeup payments and pay everything in full. That day was Dec. 31 2007. I went to Western Union, paid the full amount. The next thing I know, I got a Realtor calling me telling me my house had been sold and he bought it. Now he is trying to sell it back to us. I told him that was impossible since I paid the full amount in time. Well just like the rest of you, HSBC lied and said they had not received it nor a confirmation number, then they turned around and said, they don't even know what I am talking about that they didn't make the deal. Then they went on to say, they never got any payments. I called Western Union and talked to them about the payments and what was happening and come to find out the reason why they kept saying I was late, because in Oct. 2006 they never even took my payment. I had 3000 dollars sitting at Western Union and it is 2008?? They have been denying my payments. I have gotten a lawyer and have filed charges, I am suing HSBC. I have also filed charges so that the State of Tennessee can do and investigation.

They need to be brought down...
I am not resting until I receive justice.

I also had problems with HSBC. They charged me $35.00 a month late fees for 2 months ($70.00), even though may payments were on time. They did however reimburse me for that I am thankful. They wer trying to explain to me that I did not understand their billing cycle. They were not getting my understandng that I paid 3 times in theses 2 months all ahead of schedule. I will cancel this card.

We have had a very bad experience with HSBC and would like to join in a class action law suit against them.
They load up late charges that aren't due! They charge for identity freud insurance (and 2 different accounts for it!) in spite of the fact that we told them over and over we don't want it, even called the identity theft company ourselves.
Hopefully, tomorrow I'll be able to pay this company off in full. However, I want this company put out of business!
What they're doing to us is criminal!
Let us know if a class action lawsuit begins!

I have also nothing but problems, as mentioned previously by some others, we have credit issues now, and it is always the same months they "don't get payments" I stopped mailing them because not once did they ever receive it, odd since the checks would get cashed, but those late fees sure did add up. Also I would call and get confirmation numbers that they couldnt find in their system and was charging me an arm and a leg on these fees when in fact they never did their part and take the money out, so no matter how you pay, they wont get it. And best of all they just repossessed my car on a sunday night, mind you i have work and 2 small children, and when i called their answer was, ready for this ITS ACTUALLY OUR CAR AND WE CAN DO WHAT WE WANT WITH IT! all over disputed late fees for them not taking money out of my account and then giving me a bogus confirmation number, so i told them to keep it--and the stress is gone, but now again our credit sucks, but i would rather it suck without the headache of HSBC, just hearing it makes me sick. I am ready to sign up for a class action suit PLEASE LET ME KNOW AND WHERE TO SIGN, THIS COMPANY SHOULD BE STOPPED, WE ARE A 2-INCOME WORKING POOR FAMILY WITH BAD CREDIT--THANK YOU HSBC

I have a morgage with these crooks:
From the start (3 years ago) I had them debit my account EVERY WEEK for my payment. When I called to stop it, they told me I was behind and I would need to give them 1200 to catch it up or I would be a month late. When I told them they are the ones that have been taking the money for the payments, how can this be...I was told I should pay more attention to my statments. This is why I had them debit my account, so I would forget and get behind.
I did ask one time why my statement said I was late and I was told thats just how the system was, dont worry about it.

I have complained to the BBC regarding HSBC's ridiculous Mortgage Insurance Procedures. You have to send them proof of insurance (which is paid for a year in advance) every quarter, followed by their BS that they never recieved it and here's your new predatory rate insurance bill from our insurance cohorts to make sure you're covered.
They shred all correspondence from customers daily; lie, cheat and steal anytime they think they can get away with it.

They sold my note to Avelo and added unauthorized escrow fees despite no escrow authorization--taxes and insurance paid in full since incept.

Yes, I'd like to report improper escrow advances (in other words embezzlement of funds from my account) of about $700 as possible fuel for class action litigation.

Is anyone having difficulty with HSBC's pay by phone service? We phoned in a payment to their automated service in September and received a confirmation number. The transaction wasn't processed and I was called 10 days later by their collections department. I checked and verified that my payment did not clear the bank, however when I requested the late fees be waived citing my confirmation #, I was informed that they had no record of it (naturally, since the transaction also had failed), but that the format itself was not one they used! When we appealed via fax for a refund and submitted multiple confirmation numbers in that same format, we were denied and told that they were not valid. What do you do? Confirmation numbers are provided to protect the consumer in an electronic transaction for which there is no printed receipt. When a company denies that it exists - where do you go for resolution? I've received this confirmation number in this same format for the 36 months I've been paying via their phone service. Interestingly, the confirmation numbers in their archive simply contain the account number and a payment number that increments. Obviously, the phone system confirmation you receive is not updated in this record. To me, it borders on fraud and provides no protection to the consumer. I'd be interested in hearing from anyone else that has had a similar problem and been charged late fees from HSBC.

I am in trouble with HSBC also! they signed me up for a 2nd mortgage with out doing a appraisal on my home. I am unable to refinace because of the second mortgage. I thought this lone was a reqular personal loan. Has this happen to anyone else and what where your solutions!

I currently have a loan through HSBC and have had nothing but problems.I applied for a loan of $9500.00 and got it all was fine until I got my 1st bill. It had a $17.00 insurance charge. I called and asked them to remove it and they told me that I needed to send it in writing.(fine) So I faxed the letter to the number they gave me. On the next Statement it was on there again with a late charge,because i didn't pay the last insurance charge so i called again and again and again. it has now been almost 4 years and they still have not removed it and have charged me alot of finace charges and late fees. THis loan has killed my credit.there are alot of other issues i have had with them. way to many to list. If anyone is bringing a class action suite against them please e-mail me .

My wife and I have been having some pretty bad dealings with HSBC since May of 2007. Our payments have ALWAYS been on time, and suddenly our payment went up 120 dollars a month with no notification. Turns out HSBC overpaid the property taxes, and when the county paid them back, they failed to credit our account. It took 3 months to credit our account, and they wanted us to pay late fees! Here it is August, and this situation has yet to be completely resolved. Another issue is that my wife was originally the only one on the account (because I was in school), and we refinanced when I finished. Somehow or another, her name was taken off the account when it was supposed to be in both of our names, but now refuse to speak with my wife without prior authorization. Every time I talk to the mortgage company their policy changes on authorization of 3rd parties. First, all I have to do is tell them she can do account transactions but then 2 days later the policy changed and now I have to send in paperwork through fax. Tonight 8/21/07 I received a call, but was not home. My wife took the call, and when she mentioned that I wasn't home, the account rep proceeded to give account information to my wife. Now how is it that if you are trying to get the company to credit your account, they are adamant about speaking ONLY to the accountholder, but if money is supposedly owed to them they can divulge your account information to whomever they please!? We are ready to talk to a lawyer about the situation, because we have repeatedly tried to resolve this situation, and we don't want our credit to be affected. My mortgage was sold to HSBC is 2003, from the beginning there was big problems.. Automated service not reporting payments. They have ruined my credit I was in the 700 now below 400's. My wife is not aloud to Refinance and or Buy my home is a short sale. HSBC refused to modified my loan.
They said they could, but never did. HSBC is in violation on TIL, RESPA, and my note rate is way
over the index cap of 6.00 % I was a conforming borrower. Our 2nd lender HFC Beneifical which is OWN by HSBC, FORGOT to order or do a AVM appraisal before financing my loan (2nd). This is one manying reasons WHY I cannot refinance on Home. I am upset down on my home value....I would like to help in anyway I could in a Class Action Sued.

Well HSBC has caused tremedous heartache in our home. We sent them a cashiers bank certified check on Feb 28, 2006 12 days later we were posted for foreclosure! We had to file bankruptcy to save our home where my husband and I live with our 5 children. My husband has gone to Iraq to make better money so we paid off our bankruptcy early. We have been discharged and now HSBC is trying to send me back into foreclosure and it is starting all over again. I received a court order disallowing their Proof of Claim that they filed in my case and now it is starting all over again! The stress from all of the first wrongful foreclosure has cause major health issues for myself. I also had a miscarriage from the stress HSBC has caused. I want them out of buisness for good!

I recently sent two checks to GAP and Bananna Republic. Unfortunately I used checks within from a closed HSBC account that was closed. WHen I got notice of non payment of my gapa nd bananna republic accounts I called HSBC. They had posted many charges. I explained the mistake and the person I spoke to agreed to wave all charges but a 13 dollar service charge he said could not be waived. I then found that they used my $81 dollars as fees and cancelled payment to my gap and bananna republic accounts again. I also had explained to the parties at HSBC that I have a visual problem and used these checks in error. I have been documenting my problems with this bank and I am interested information regarding lawsuits against this bank. Thank you

I'm all about shutting the company down. I had a equity loan for 1 year and it was a problem from the start. They miscalculated my 1st payment and then sent me a notice to pay a diferent amount than on my statement, after that there was always problems. I closed the account 8/06 and they reported it open until 03/07, when I demanded that they update the account they then added a 30 day late payment for 8/06. How the hell do you add a 30 day late payment to a account 7 months after it was closed?

Im also having problems with hsbc I have refinanced just to get away from past exsperiance and 2 months later they bought me from the new lender haveing the same problems there not paying my mortage insuance witch is in my contracted also my 15 day grace period dosent exsist all though my contract states it I recive numeris calls for payment before the first and after very rud employees have sent them many copys of contract just like the past showing them I have a 15 day grace period payed many late fees for nothing just to keep my credit good the same thing goes for my home owners inc never recived refund from the past my gole this time is to recive everything they owe me this time Ill probubly spend a lot more on atterny fees then what they owe me but mybe the next person wont get screwed like me and im shure many others have had same problems

HSBC is threatening to throw me & my daughter out into the streets over a $7500 homeowners policy they allegedly purchased from SafeCO back in 9/06. I was allegedly sent a copy of the policy is 11/06, which I never received. In 12/06, they wanted the entire balance paid in full. I got Allstate to send them a $2400 policy & they backed off when I copied a CA referral to the State Attorney's office. Now they want the insurance premium of $3,000 for the few months that they allegedly had another policy with SafeCo. or threaten to proceed to foreclose on my property. This is extortion & blackmail. I will bring suit against them & shut them down for their blatantly criminal activities at the first opportunity. I am in Florida & will be opening up a website for others who are in the same situation.

Hi! We are going through the EXACT same problem right now regarding our Nov. 2006 payment. We have faxed and faxed and done ALL of THEIR homework for them. They REFUSE to cooperate, refuse to let us talk to the Cash Dept, and recently sent us a Forclosure letter. NICE! We are completely current on all mortgage payments (1st and 2nd) and this is the ONLY company we have repeated problems with! PLEASE LET US KNOW if you have gotten anywhere w/ a lawsuit. We TOO are ready to fight. This should not happen to anyone else!!!!!!!!!!!!

I'm writing regarding a company by the name of HSBC Mortgage. This company has ruin my credit and refuse to help me resolve the problem. I made a payment on October 15, 2006 through the automated service. Two weeks later I receive my November statement showing double payments owed. When I called the company to complain and ask why the payment was not received, I was told that it was a computer problem and the account number I entered was off by a couple of digits. I called Corporate to see if they could correct the problem. But a person by the name of Stasha Bailey stated "there was nothing she could do to remove the 30 day late off my credit report." I explain that this was not the first time I've had problem with there automated service. When I ask to speak with the top Executive Corporate Officer they refuse to give me any information and would not put me through. My credit score went from being above 650 to 553. I extremely upset and I'm ready to fight. I need everyone who has had problems with this company to come forward and fight with me. If there is already a class action lawsuit against this company then please email me. If not then all who are tired of Mortgage companies destroying your credit, please join me in started a class action lawsuit against HSBC Mortgage. Having good credit means everything and when a company only cares about ruin your credit score, what does that say about that company.
