eBay Class Action Suit

On the face of it, this seems like a lame suit. Auctions never force people to pay more money.

EBay Inc. (EBAY.O: Quote, Profile, Research) is being sued by a Pennsylvania man who charges that it illegally forces up prices when certain high bidders raise their maximum bid to guard against last-minute offers, an attorney for the plaintiffs said on Wednesday.

In a proposed class-action lawsuit filed Feb. 17 in Santa Clara County Superior Court, lead plaintiff Glenn Block claims that eBay raised his bid from $111 to $112.50 after he responded to an e-mail from auction site that said he was the highest bidder for an item.

The email warned that he could be outbid if he did not increase his maximum.

Block alleged that he could have won the auction at $111, and accused eBay of forcing him to overpay by $1.50.

"Based on what we know about what's being alleged, it appears the plaintiff completely misunderstands the functionality of the eBay bidding system," eBay spokesman Hani Durzy said. He said the company had not yet seen the lawsuit.

We set up a 10 day auction that was ended in 8 days, eBay claiming that we had ended the auction early and wished to sell to the high bidder: BULLSHIT!!! Then they refused to take action and charged our account for the fraudulant sale. Our complaints have gone unanswered. Ebay should be investigated by the attorney general. William Carlyle

I have had an Ebay seller who cashed my check for $119.84, keep the money and never sent me anything except rabidly insulting email. Ebay's protection guarantee is bullshit. They said if I sent them a copy of the cancelled check they would reimburse me about half of it, that amount being minus the hefty shipping fees and minus a $25 Ebay service fee, (yes, they want you to pay them a service fee while they screw you!). But when they got the copy of the check they didn't reimburse me even half! They told me not to inquire anymore or expect to hear anymore for 4 weeks, then, 3 weeks later, they sent me an email saying they were dropping the case because an email they sent me had gone unnoticed for more than 72 hours. So, they didn't even reimburse half. So much for Ebay protection guarantee. They have proof the seller cashed the check and kept the money, sent nothing, and yet, they are still allowing her to run 92 auctions at a time on Ebay. Ebay is one big gaggle of Ebay sanctioned theives. I found this site while looking for the Ebay Class Action website. Apparently a lot of folks get ripped off on Ebay. They, through thier fraudulent seller, only stold $119.84 from me, but, if they stold that much from a hundred or a thousand people a day, they'd be stealing quite a lot of money. This sort of crime should not go unnoticed by law enforcement, because of small amounts frome each victim, but it shouldn't because it is a large scale scam. It is nearly impossible to take their fraudulent sellers to small claims court, because it would cost more to fly to their town and stay there a couplfe of weeks than they robbed you of it the first place. Therefore fraud is a flourishing and safe business for Ebay sellers. Crime is being rewarded. Be advised an Ebay seller calling herself "AKidPlace" is a theif, keeps the money, never sends you anything, and leaves you bad feedback when you say she kept the money and never sent you anything. From now on I will shop elsewhere.
